These Terms and Conditions ("Terms") govern your use of our website (www.carnivalcravings.ca), our physical stores (if applicable), and your purchase of our products.

Returns and Exchanges

  • We offer returns and exchanges on unopened and unused supplies and moulds/molds within 30 days of purchase.

  • You are responsible for the cost of return shipping.

  • Due to the nature of the products we sell, we will not accept returns on used or opened products, custom-made products, sale, or personal care items.

Product Liability

Carnival Cravings Ltd. (the "Company") warrants that all confectionery products are prepared in accordance with applicable health and safety standards at the time of delivery or pickup. Except as expressly provided herein, all products are sold "as is," and the Company makes no other warranties, express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose.

The Customer acknowledges that products are prepared in a kitchen that handles common allergens, including but not limited to nuts, gluten, dairy, soy, and eggs. While Carnival Cravings takes precautions to prevent cross-contamination, the Company cannot guarantee that any product is 100% allergen-free. It is the Customer’s sole responsibility to notify any end-consumers of these potential allergens.

Upon transfer of the product to the Customer (via pickup or completed delivery), the Company shall not be held liable for any damage, spoilage, or illness resulting from:

  • Improper Storage: Failure to maintain products at the recommended temperature (e.g., refrigeration for savory items or humidity control for sweets).

  • Delayed Consumption: Consumption of products beyond the recommended "best by" date provided at the time of sale.

  • Third-Party Handling: Any alteration or contamination of the product by the Customer or a third-party delivery service.

To the maximum extent permitted by law, the Company’s total liability for any claim arising out of the sale of its products—whether in contract, tort, or otherwise—shall not exceed the purchase price actually paid by the Customer for the specific product giving rise to the claim. In no event shall Carnival Cravings be liable for any indirect, incidental, or consequential damages.

The Customer agrees to indemnify and hold harmless Carnival Cravings and its employees from any claims, losses, or expenses (including legal fees) arising from the Customer’s negligence, misrepresentation of ingredients to third parties, or failure to follow storage instructions.

Intellectual Property

The content of our website and our products are protected by intellectual property laws.

You may not use any of our trademarks, copyrights, or patents without our express written permission.

Governing Law

These Terms will be governed by and construed in accordance with the laws of Alberta, Canada.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of our website and products.

Changes to Terms

We reserve the right to change these Terms at any time. You are responsible for checking these Terms periodically for changes.

WE PROVIDE OUR WEBSITE AND PRODUCTS "AS IS" AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
